Hollandiyada boşanma: hüquqi addımlar və emosional təsir

Boşanmanın emosional aspektləri Hollandiya ailə hüququ

A Dutch court grants a divorce on one ground only: the marriage has broken down irretrievably (duurzame ontwrichting), under Article 1:151 of the Dutch Civil Code (BW). No fault has to be proved and the wish of one spouse is enough, but the petition must always be filed by a Dutch lawyer (advocaat), and the divorce only takes effect once it is registered with the civil registry.

The legal side runs on fixed deadlines; the emotional side follows its own pace. This article explains what Dutch divorce law requires, which decisions the court takes on property, children and maintenance, and how to keep the legal track and the personal track apart. For a broader overview of the procedure, see our guide to Hollandiyada boşanma.

What is the legal ground for divorce and who may file?

The only ground is irretrievable breakdown, and the court does not examine who caused it. If one spouse states that the marriage is over, that is in practice decisive.

Divorce is requested by petition to the district court (rechtbank), and representation by an advocaat is mandatory. A mediator or a legal adviser who is not admitted to the Dutch Bar cannot file the petition. Spouses who agree on everything can file a joint petition (gemeenschappelijk verzoek) under Article 1:154 BW, often with one lawyer for both. Under the same article, each spouse may withdraw the joint petition until the court gives its decision. Where interests conflict, each spouse needs their own lawyer.

A registered partnership can end without a court. Under Article 1:80c BW, partners can end it by mutual consent through a declaration signed by them and one or more lawyers or notaries and registered by the civil registrar. Since 1 January 2023, that route is closed to partners who exercise authority over joint children. A marriage always requires a court decision.

How do the divorce proceedings run?

The lawyer files the petition with the marriage certificate and, where there are children, their birth certificates. Where the spouses have minor children, Article 815 of the Dutch Code of Civil Procedure (Rv) requires a parenting plan (ouderschapsplan) signed by both parents.

The parenting plan must at least cover how the parents divide care and upbringing, how they inform and consult each other about important matters, and the costs of the children. If a plan cannot reasonably be produced, the petitioner must explain why, and the court may set the arrangements itself. In a unilateral petition, the other spouse can file a statement of defence (verweerschrift) with counter-requests, for example on maintenance or the home. A joint petition with a signed divorce settlement (echtscheidingsconvenant) is often decided without a hearing and much faster than a contested case.

Boşanma nə vaxt qüvvəyə minir?

Only when the court decision is entered in the civil registry, under Article 1:163 BW. That must be requested within six months after the decision has become final; otherwise the decision lapses and you have to start again.

Under Article 358 Rv, an appeal to the court of appeal (gerechtshof) can be lodged within three months of the decision. If neither spouse wants to appeal, both can sign a deed of acquiescence (akte van berusting), which makes the decision final at once so that it can be registered without waiting three months.

What can be arranged while the divorce is pending?

Urgent matters are settled through provisional measures (voorlopige voorzieningen), under Articles 821 and 822 Rv. The oral hearing must start no later than the third week after the request.

The court can decide who may use the marital home, where the children live, a provisional contact arrangement and provisional maintenance. A measure requested before the divorce petition lapses if the petition is not filed within four weeks. Our article on boşanma prosesində müvəqqəti tədbirlər explains this route in more detail.

Which court has jurisdiction and which law applies?

You do not always need to live in the Netherlands. Jurisdiction follows Regulation (EU) 2019/1111 (Brussels IIb), to which Article 4 Rv refers, and it offers several alternative grounds, including the spouses’ habitual residence and their common nationality.

Two Dutch nationals living abroad can therefore often divorce in the Netherlands. The law that governs the divorce itself is a separate question. The Netherlands does not apply the EU Rome III Regulation; under Article 10:56 BW, a Dutch court applies Dutch law, unless spouses with a common foreign nationality choose the law of that country. Matrimonial property, maintenance and parental responsibility each have their own conflict rules, so a Dutch court may apply Dutch law to the divorce and foreign law to the property regime.

How are assets, debts and pension divided?

Unless you made marital conditions (huwelijkse voorwaarden), the community of property is divided in equal shares under Article 1:100 BW. For marriages from 1 January 2018 that is a limited community; older marriages fall under the general community, in which pre-marital assets and inheritances are in principle shared too.

Debts follow the same rules. A joint mortgage stays a joint liability towards the bank until the bank releases one spouse. Full disclosure is essential: under Article 3:194(2) BW, a spouse who deliberately conceals or hides a joint asset forfeits their share in it to the other spouse. Our article on property division in a Dutch divorce explains the rules in detail.

Pension is divided separately, under the Pension Rights Equalisation on Divorce Act (Wet verevening pensioenrechten bij scheiding, WVPS). Each spouse is in principle entitled to half of the retirement pension the other built up during the marriage. Notify the pension provider within two years after the divorce, under Article 2(2) WVPS, so that it pays your share directly. Tax consequences of the settlement belong with a tax adviser.

What is arranged for the children?

Divorce does not end joint parental authority. Under Article 1:251(2) BW, parents who had joint authority keep it; under Article 1:251a BW, the court grants sole authority only if there is an unacceptable risk that the child gets trapped between the parents, or if it is otherwise necessary in the child’s interest.

The real questions are usually the care arrangement, the child’s main residence and school. Under Article 809 Rv, children aged twelve and older are given the opportunity to give their views to the court; younger children may be heard as well. Our overview of Hollandiyada uşaq qəyyumluğu qanunu covers these decisions in depth.

Child maintenance (kinderalimentatie) is calculated on the child’s needs and each parent’s capacity to pay, using the national standards of the Expertgroep Alimentatienormen. Under Article 1:402a BW, maintenance amounts are indexed every year by operation of law on 1 January. Under Article 1:395a BW, parents remain liable for the costs of living and study of their children until the age of 21.

Tərəfdaşın saxlanması nə qədər davam edir?

For divorces petitioned from 1 January 2020, partner maintenance (partneralimentatie) ends by law after half the length of the marriage, with a maximum of five years, under Article 1:157 BW. The amount depends on the recipient’s need and the payer’s capacity, based on payslips, bank statements and annual accounts.

There are exceptions. If there are children of the marriage under twelve, maintenance runs at least until the youngest turns twelve. If the marriage lasted more than fifteen years and the recipient is no more than ten years below the state pension (AOW) age, it runs until that age. Where several exceptions apply, the longest term counts. Under Article 1:160 BW, maintenance ends if the recipient remarries, registers a partnership or cohabits as if married. Our Hollandiyada aliment üzrə bələdçi hesablamanı müəyyən edir.

An amount can be changed if circumstances change significantly, such as job loss or a new household. Spouses can agree in writing that the amount cannot be changed (a non-modification clause), but under Article 1:159 BW the court can still set it aside after a change so drastic that holding the payer or recipient to it would be unacceptable.

How do you deal with the emotional side?

Keep the personal track and the legal track separate, but run them at the same time. Agreements signed in the middle of an escalation are the ones that often come back years later as a request to vary or annul them.

A lawyer is not a therapist. Legal support takes the procedural weight off you: filing on time, collecting financial documents, putting proposals in writing and requesting provisional measures within weeks if the situation at home is untenable. Mediation works well where both spouses still want a workable arrangement, especially with children. Where one party refuses to disclose information, the court route is the right one. Personal support belongs with your general practitioner, a psychologist or counsellor, a family coach for the children, and your own network.

Ərizə verən həyat yoldaşı olaraq nəyi yoxlamalısınız?

As the petitioner, you set the timetable. Check the following before your lawyer files:

  • whether a Dutch court has jurisdiction and which law applies to the divorce and to your property;
  • whether you have an overview of all assets, debts and pensions on the filing date;
  • whether a parenting plan is ready, or why it cannot be;
  • whether provisional measures are needed for the home, the children or maintenance;
  • whether you have agreed who will request registration within six months after the decision is final.

As the respondent, you can file a defence and your own requests within the period set by the court. Check the following:

  • the deadline for your statement of defence in the court’s notice;

  • whether the petitioner’s financial figures are complete and supported by documents;
  • whether you need to leave the marital home, or whether you can ask for its use;

Tez-tez soruşulan suallar

Do I need a lawyer to get divorced in the Netherlands?

Yes. Only an advocaat can file a divorce petition with the district court, whether it is joint or unilateral. Spouses who agree on everything can share one lawyer for a joint petition; where interests conflict, each spouse needs their own.

Hollandiyada boşanma nə qədər çəkir?

That depends on the level of agreement. A joint petition with a signed settlement and parenting plan is often decided without a hearing; a contested case takes considerably longer. The divorce takes effect on registration, which must be requested within six months after the decision is final.

Xaricdə yaşayıramsa, Hollandiya məhkəməsi boşanmamı dinləyə bilərmi?

Often, yes. Jurisdiction follows Regulation (EU) 2019/1111, which includes the common nationality of both spouses as a ground. Under Article 10:56 BW, the Dutch court then applies Dutch divorce law, unless spouses with a common foreign nationality choose that law.

Boşanmanın yaratdığı gərginliyi necə idarə edə bilərəm?

Keep the personal and the legal track separate. Use your general practitioner, a counsellor and your own network for the personal side, and let your lawyer handle deadlines, documents and communication. Provisional measures, heard within about three weeks, can create breathing space.
