How do you apply for a divorce in the Netherlands?

You apply for a divorce by having a lawyer file a petition with the district court. The marriage ends only when the court's decision is entered in the civil status registers.

Under Article 1:151 of the Dutch Civil Code, the only ground for divorce is that the marriage has irretrievably broken down. Dutch law does not look at who is to blame. Your spouse cannot block the divorce itself, but can dispute the arrangements around it. You can read Book 1 of the Civil Code on wetten.overheid.nl (Holland dilində).

Joint petition

With a joint petition, you and your spouse file one request together, through one lawyer or two. You attach the divorce agreement and, if you have minor children, the parenting plan. The court usually decides on the documents without a hearing. Read more about the boşanma müqaviləsi.

One-sided petition

With a one-sided petition, only you file a request. A bailiff then serves it on your spouse, who generally has six weeks to file a statement of defence. Your spouse may also file counter-requests, for example on maintenance or the home. An oral hearing at the court usually follows. See also partnyorunuzun razılığı olmadan boşanma.

What must you arrange when you have children?

If you have minor children, the divorce petition must include a parenting plan. If you cannot submit one, you must explain why in the petition.

The parenting plan is required by Article 815 of the Dutch Code of Civil Procedure. It covers at least the division of care and upbringing, how you inform and consult each other, and the costs of care and upbringing. Children aged 12 and older are invited by the court to give their view. Younger children may also be heard if the court considers that appropriate.

After the divorce, both parents usually keep joint parental authority. Child support takes priority over partner alimony. Our pages on uşaq dəstəyi, ortaq aliment və valideynlik planı explain these topics in more detail.

How long does applying for a divorce take?

A joint petition is often decided within a few weeks to a few months after filing. A one-sided petition with disputes about children, money or the home can take a year or longer.

After the decision, there is an appeal period of three months. You can shorten this if both spouses sign a deed of acquiescence (akte van berusting), waiving the right to appeal. The decision must then be entered in the civil status registers within six months after it has become final. Under Article 1:163 of the Dutch Civil Code, the decision lapses if this deadline is missed. Our article on boşanma nə qədər çəkir gives more detail.

Can you apply for a divorce in the Netherlands if you are an expat?

Yes, a Dutch court can often hear your divorce if you or your spouse live in the Netherlands. The decisive factor is usually habitual residence, not nationality or where you married.

Within the EU, jurisdiction follows Regulation (EU) 2019/1111 (Brussels II-ter). A Dutch court can, for example, hear the case if both spouses live here. It can also do so if you have lived here for at least one year before filing. Once the Dutch court has jurisdiction, it applies Dutch law to the divorce itself. Different rules may apply to your matrimonial property, maintenance and pensions.

Two points need attention early. First, check whether a divorce granted here will be recognised in your home country. Second, check whether your residence permit depends on your marriage, because the IND must then be informed. Read more about Hollandiyada beynəlxalq boşanma və boşanma və yaşayış icazəniz.

And a registered partnership?

Registered partners without joint minor children can usually end their partnership without going to court. They sign an agreement with a lawyer or notary, which is then registered with the civil registry. With minor children, a court procedure similar to a divorce is required.

Tez-tez soruşulan suallar

Do I need a lawyer when applying for a divorce in the Netherlands?

Yes. A divorce petition can only be filed with the district court by a lawyer. With a joint petition, one lawyer can act for both of you, provided you agree on everything. If you disagree, each spouse should have their own lawyer, because one lawyer cannot defend two opposing interests.

Can my spouse refuse a divorce?

No. Under Dutch law, the only ground is that the marriage has irretrievably broken down, and your statement that it has is usually enough. Your spouse can, however, dispute the arrangements, such as maintenance, the home or the children. Those disputes determine how long the procedure takes.

Can we use one lawyer together?

Yes, if you file a joint petition and agree on all arrangements. The lawyer then drafts the divorce agreement and parenting plan for both of you. If a conflict arises during the process, that lawyer may no longer act for either of you. You then each need a new lawyer.

Boşanma nə vaxt yekunlaşır?

The divorce is final when the court's decision is entered in the civil status registers. This happens after the three-month appeal period, or sooner if you both sign a deed of acquiescence. Registration must take place within six months after the decision has become final, otherwise the decision lapses.

Can I divorce in the Netherlands if I married abroad?

Often yes. What usually matters is where you and your spouse habitually live, not where you married. A Dutch court then applies Dutch law to the divorce itself. Check early whether the Dutch decision will be recognised in your home country, as recognition rules differ per country.

What happens to my residence permit after a divorce?

If your permit is based on your relationship with your spouse, the basis for that permit ends with the divorce. You must report the change to the IND. Depending on your situation, you may qualify for a different residence permit. We advise you on this before you file the petition.
